klinnect Terms and Conditions of Service
Welcome to klinnect (the "Platform" or "Service"). These Terms and Conditions ("Terms") govern your use of the Platform and its associated services, including the messaging features and the marketplace. By accessing or using klinnect, you'll agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. User Accounts and Data Privacy

2.5 Mobile Device Data & Push Notifications
To provide native push notifications via OneSignal, our Mobile App collects your Device ID and hardware model information. This data is used solely to route notifications to your specific device and is not used for cross-app tracking or advertising profiles. You may opt-out of these notifications at any time through your mobile device system settings.
3. User Content and Messaging
3.1 Direct Message Privacy
Direct messages sent between users on the Platform are strictly private and confidential between the sender and the receiver. klinnect does not monitor the content of direct messages, except where legally required or when investigating a reported breach of these Terms.
3.2 Image Deletion Policy
To ensure user privacy and efficient service, images sent to other users through the messaging service will be automatically deleted from our servers after 30 days from the date they were sent. Text-based messages may be retained indefinitely for account history, unless you exercise your right to data deletion (Section 2.3).
3.3 Responsibility for Content
You are solely responsible for all content, including messages, images, and advertisements, that you upload, post, or transmit through the Platform.
4. Marketplace Terms
4.1 klinnect's Role
klinnect is solely a **platform to advertise goods and services.** We provide a venue for users (buyers and sellers) to interact, but we are not a party to any resulting transaction.
4.2 Buyer and Seller Responsibility
The buyer and seller are fully and solely responsible for all aspects of their transactions. This includes, but is not limited to:
- The quality, safety, and legality of the items or services advertised.
- The truth and accuracy of listings.
- The completion of payment.
- The shipping, delivery, or return of items.
- The resolution of any disputes that may arise.
4.3 Estimated Price Disclaimer
Any estimated prices or valuation guides provided for rolling stock items or other goods on the Platform are for reference and informational purposes only. These estimations do not constitute an offer to buy or sell, or a guarantee of current market value. **Users must not treat these estimated prices as a source of truth** for setting or negotiating transaction prices. klinnect takes no responsibility for the accuracy of estimated prices or any reliance placed upon them by users.
4.4 Limitation of Marketplace Liability
klinnect has no control over and does not guarantee the existence, quality, safety, or legality of advertised items; the truth or accuracy of user content or listings; or the ability of buyers to pay or sellers to complete a sale. **klinnect will not be liable for any disputes, damages, or losses arising from or related to any transaction conducted through the Marketplace.**
5. Site Conduct and Enforcement
5.1 Prohibited Conduct
You agree not to engage in any activity that is harmful, illegal, or disruptive, including:
- Hacking: Attempting to gain unauthorized access to any part of the Service, other users' accounts, or the Platform's infrastructure.
- Copying: Illegally duplicating, modifying, or distributing any content, code, or design elements of klinnect.net without express written permission.
- Breach of Rules: Violating any of these Terms, the Privacy Policy, or any other policies posted on the Platform.
5.2 Investigation and Action
Any **breach of these rules, copying, or hacking attempts will be thoroughly investigated.** Depending on the severity of the offense, klinnect reserves the right to take appropriate action, including, but not limited to:
- Immediate temporary or permanent suspension or termination of your account.

All rights are reserved.. You retain ownership of all intellectual property rights in your User Content (e.g., advertisements, messages) you post to the Service.
6.2 The Service, including all design, text, graphics, and software code, is the proprietary property of klinnect.net. The Platform may display references to third-party brand names such as Märklin. All intellectual property rights associated with these third-party materials belong exclusively to their respective owners. klinnect does not claim any ownership of Märklin or any other third-party brand.
The Platform may display photos or references to third-party brand names, such as **Marklin**. You acknowledge that all intellectual property rights, **copyrights, and trademarks associated with these third-party materials belong exclusively to their respective owners.** klinnect uses these names and images solely for informational or marketplace advertising purposes and **does not claim any ownership, endorsement, or appropriation** of the intellectual property of Marklin or any other third-party brand.
7. Limitation of Liability
To the maximum extent permitted by law, klinnect.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service (including the Marketplace); or (c) unauthorized access, use, or alteration of your transmissions or content.

These Terms shall be governed by the laws of Portugal without regard to its conflict of law provisions.
